Hooked on a Fake “Free Trial”?
Our attorneys are investigating the possibility of a class action claims against several cosmetic and supplement companies. You may have seen the claims online—glowing reviews from people who are supposed to be actual customers, amazing before and after photos, and more.
“We’re so confident that we’ll give you the first bottle free!” They practically shout about their success. There are glowing reviews from people who are supposed to be actual customers or claims about “clinical trials.”
Our attorneys believe their claims are false
We’ve conducted a lengthy investigation of complaints and other issues with these products. Some people have even posted complaints on Amazon of allergic reactions. What is true is that the companies get your credit card and charge it over and over. They even try to trick the credit card companies when you attempt charge backs. It’s fraud and it’s not ok.
Companies have a duty to be truthful to their customers. They cannot bill you for a subscription you did not agree to.
We Want to Take Action
We want to do something about this. The attorneys at Kneupper & Covey PC handle false advertising claims, and we hold companies accountable for what they say and do. One way to do this is a class action lawsuit.
In a class action lawsuit, a few people go to court to represent a much larger group. Let’s say that thousands of people bought a certain product. A few of those customers can file as a class action, seeking damages on behalf of the entire group.
Those people who file the lawsuit are called a “class representative.” To file a lawsuit, someone who bought the product needs to be that class representative. And our firm is looking for people who might be interested.
What does it mean to be a class representative?
A class representative is someone from the group of injured people who agrees to work with the attorneys and make decisions on behalf of that group. They may have to explain their experience under oath in a deposition, or in court in the rare circumstance that a case goes all the way to a trial.
Why would anyone want to do this?
Partly because it helps stop companies from taking advantage of their customers, and it’s often the only way to make them follow the law.
Because you are fighting for everyone, you need to do a little more work: asking questions of your lawyer, reading court documents, and taking the time to think of everyone else. Sometimes, because of the extra work, if we win this case as a class action, the Court may approve your receiving what is called an “incentive award.” This means you can get some compensation because of the additional time and responsibility spent being a class representative. But that’s not a guarantee, and it depends on the particular case and the Court.
